Agreement
These Terms of Service (“Terms”) govern your access to and use of the ProductSight application and this website (the “Service”). By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
ProductSight monitors publicly available competitor prices, notifies you when a tracked competitor is priced below your own products, and — when you enable it — can automatically reprice your products according to rules you configure. The Service accesses your product catalog through Shopify with your permission and is provided on a subscription basis.
Eligibility and accounts
You must operate an active Shopify store and have authority to install apps for it. Installation and authentication are handled through Shopify; you are responsible for activity that occurs under your store account.
Billing
- Paid plans are billed through Shopify under Shopify Managed Pricing, subject to Shopify's billing terms.
- Paid tiers may include a free trial; unless you cancel before it ends, the plan converts to a paid subscription.
- You can change or cancel your plan at any time from Shopify; cancellation stops future charges and takes effect at the end of the current billing period.
- Fees are non-refundable except where required by law.
Acceptable use
You agree not to:
- Use the Service in violation of any law or the rights of others.
- Reverse engineer, resell, or attempt to gain unauthorized access to the Service or its data.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to harass competitors or to access non-public data.
Pricing data — no warranty of accuracy
Competitor pricing is collected from public sources and may be delayed, incomplete, or inaccurate. The Service provides information to support your decisions; it is not pricing, business, financial, or legal advice. You are solely responsible for your own pricing decisions and for ensuring they comply with applicable laws. When you enable automatic repricing, price changes are applied according to the rules you configure, and you remain responsible for those rules and the resulting prices.
Intellectual property
The Service, including its software, design, and content, is owned byProductSight and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect. Your store data remains yours.
Third-party services
The Service relies on third parties, including Shopify and the competitor storefronts you choose to track. We are not responsible for third-party services, their availability, or their content, and your use of them is subject to their own terms.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will be complete or accurate.
Limitation of liability
To the maximum extent permitted by law, ProductSight will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the claim.
Indemnification
You agree to indemnify and hold ProductSight harmless from claims arising out of your use of the Service or your violation of these Terms.
Termination
You may stop using the Service at any time by uninstalling it. We may suspend or terminate access if you breach these Terms or to comply with law. Provisions that by their nature should survive termination will do so.
Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date and, for material changes, provide notice through the app or by email. Continued use after changes take effect constitutes acceptance.
